My understanding is that Mazz made the patterns available for free, with the understanding that nobody would attempt to sell or redistribute the pattern, or any items made with the pattern (standard internet knitting/crochet/sewing pattern copyright and etiquette). And then someone else disregarded the copyright notice and went ahead and sold the items on E-bay. Once the E-bay seller's auctions were shutdown, an anonymous source informed the BBC of Mazz's site, and the shutdowns began.
Many fan-created patterns celebrating Doctor Who were yanked from the internet in the terrorstorm surrounding Mazz's case. (The famous Doctor Who Scarf website also went down during this period, but it turned out to be a coincidence rather than the overzealous arm of the BBC.) Happily, a situation has been worked out with the BBC, and the BBC even asked Mazz to knit a whole bunch (100, I think) of Adiposes for promotional purposes.
I'm still holding out a vague hope that they offer Mazz a publishing deal... I managed to get a second-hand copy of the enchantingly 80s Doctor Who Pattern Book, but it's a little short on knitting and crochet patterns. A new pattern book that includes the knit TARDIS, ExtermiKNIT Daleks, and Mazz's creatures (I believe she's created patterns for Face of Boe and Ood in addition to the Adipose) would be nifty, and hopefully the BBC would, in fact, be totally okay with people who make their own stuff NOT for profit. Otherwise, what are they gonna do? Sue everyone who ever cosplayed for competing with any Doctor Who costumes they might want to sell?

It's a complicated question. Supposedly the reason LFL had resisted doing stormtrooper armor for so long is they didn't want a bunch of unauthorized fools running around in Star Wars costumes, but then we all saw George marching around with the 501st in the Rose Parade. Consistency yay!
They have cute Adipose stationery sets on the new Dr Who magazine, I saw them and squeed at how cute they were! Not cute enough for me to buy it but I'd pick them up for anyone who wanted one!
